By creating an account, accepting an invitation, or using Early Check-In in any way, you agree to these Terms of Service ("Terms"). If you are using Early Check-In on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
These Terms constitute a binding agreement between you and Elsewhere Index LLC, a limited liability company organized under the laws of the State of Texas ("Elsewhere Index," "Early Check-In," "we," "us," or "our"). If you do not agree to these Terms, do not use the service.
Early Check-In is a software communication tool for short-term-rental owners and property managers. It lets you track unit-turnover status in real time. Cleaners scan a QR sticker posted in the property, which opens a public web page; tapping a button marks the unit ready and sends you a push notification. You see a live status board across all your properties.
That is the whole service. Early Check-In is a signaling and notification tool. Nothing more.
This section is important. Please read it carefully.
Early Check-In is not a staffing service, a cleaning service, a marketplace, a recruiting platform, or a vetting service. We are a software tool.
Specifically, Elsewhere Index LLC:
You, the host or property manager, bring your own cleaner. The cleaner relationship — including selecting, vetting, hiring, supervising, paying, and insuring your cleaner — is entirely your own. Early Check-In is the tool you use to receive a status signal from your cleaner. Nothing about using Early Check-In creates any relationship between Elsewhere Index and your cleaner, or makes Elsewhere Index responsible for your cleaner's actions, omissions, or fitness for any purpose.
Eligibility. You must be at least 18 years old and have the legal capacity to enter into a contract to use Early Check-In.
Accounts. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
Invitations. When you invite a co-manager using Early Check-In, you represent that you have authorization to share their contact information with us for this purpose, and that the invitation is appropriate and expected. You are responsible for managing who has access to your organization in Early Check-In.
Accuracy of information. You represent that the information you provide — including organization names, property names, invited-manager contact details, and any cleaner names or labels you type — is accurate, that you have the right to provide it, and that doing so does not violate any third party's rights.

The "ready" status in Early Check-In reflects the last scan event received from the QR page. It is a communication signal, not a guarantee.
The status signal may be:
You must not rely on the Early Check-In status signal as the sole basis for concluding a property is clean, prepared, guest-ready, or safe. The signal is one input, not a substitute for your own inspection and judgment before a guest arrives. Elsewhere Index makes no warranty that any status signal is accurate, timely, or complete.
Early Check-In is billed on a per-property subscription:
"Active property" means a listing in your account that has not been deleted. The quantity billed is derived from your active property count at the time of billing and may be adjusted when you add or remove properties.
Prices are stated in US dollars.
How you are billed depends on where you subscribed.
If you subscribed on our website, payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis at the applicable rate. Elsewhere Index does not store your payment card number, expiration date, or CVV. Card data is held exclusively by Stripe.
If you subscribed inside the iOS app, the purchase is an Apple in-app purchase. Apple bills your Apple Account, and the subscription renews automatically through that account until you cancel it. Elsewhere Index never receives or stores your payment details for these purchases. Prices are shown in the currency of your App Store region and follow Apple's price points for that region, so they may differ from the US dollar amounts in 7.1.
Onboarding and initial setup are free. The owner-facing features of the board (live status, push notifications, mark-ready, and the early-check-in log) require an active subscription. Setting up your organization, adding properties, and posting stickers do not require a subscription.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to paid features through the end of the period for which you have paid.
If you subscribed inside the iOS app, Apple controls cancellation. Cancel it in Settings, then your Apple Account, then Subscriptions. We cannot cancel an App Store subscription on your behalf, and deleting your Early account does not cancel it. If you delete your account while an App Store subscription is active, Apple will keep billing you until you cancel it yourself.
All subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or fees already paid, except where a refund is required by applicable law. If you cancel, you retain access through the end of the current paid period and are not charged for the next.
Refunds for subscriptions purchased through the App Store are handled by Apple, not by us. Request one at reportaproblem.apple.com. We cannot issue or deny a refund for an Apple purchase.
If you add a property, your subscription quantity increases and you are charged a prorated amount for the remainder of the billing period. If you remove a property, your subscription quantity decreases and you receive a prorated credit applied against future invoices (not a cash refund). If you remove all active properties, your subscription is scheduled to cancel at the end of the current period; re-adding a property requires starting a new subscription.
We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase to active subscribers, by email or in-app notice. Continued use of the service after a price change takes effect constitutes your acceptance of the new price.
You are responsible for any applicable taxes on your subscription. We do not currently collect sales tax; this may change. We will provide notice if we begin collecting tax.
Early Check-In and all content, software, and designs we create are owned by Elsewhere Index LLC or our licensors. These Terms do not grant you any right to use our trademarks, logos, or brand.
You retain ownership of the data you enter into Early Check-In (property names, organization names, and other content you create). You grant us a limited, non-exclusive license to store and process that data to operate the service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
To the maximum extent permitted by applicable law, Elsewhere Index LLC expressly disclaims all warranties, express or implied, including but not limited to:
We do not warrant that the service is suitable for use in safety-critical decisions, and it is not designed or intended for such use.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
10.1 Elsewhere Index LLC's total cumulative liability to you for any claims arising out of or related to these Terms or the service — regardless of the form of action, whether in contract, tort (including negligence), or otherwise — is limited to the total subscription fees you paid to us in the 12 months immediately preceding the event giving rise to the claim.
10.2 In no event will Elsewhere Index LLC be liable for any:
10.3 These limitations apply even if Elsewhere Index has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Elsewhere Index LLC and its officers, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
By you. You may cancel your account at any time. Cancellation of a subscription is addressed in Section 7.4. Account deletion is available in the app and as described in our Privacy Policy; deleting your account ends access immediately and you are not refunded for the remainder of the period you have paid for. If you subscribed on our website, deletion cancels that subscription. If you subscribed inside the iOS app, deletion does not cancel it. Apple bills that subscription and only you can stop it, as described in Section 7.4.
By us. We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason we determine in good faith requires action to protect the service or other users. We will provide notice where practicable.
Effect of termination. Upon termination, your right to access the service ends. Data deletion follows the schedule described in our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions.
Any dispute arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Texas.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, for material changes, provide notice by email or in-app. Continued use of the service after the revised Terms take effect constitutes your acceptance.
